Casa Rento B.V. (in the following: “Casa Rento”) respects the privacy of whomever whose personal data are processed by Casa Rento, also including the data of the visitors and users of the website www.casarento.com (in the following: “the Platform”). Casa Rento deems the diligent handling of personal data of the highest importance. Casa Rento will process your personal data in accordance with the General Data Protection Regulation (Regulation (EU) 2016/679 of the European Parliament and the Council of 27 April 2016).

Casa Rento processes personal data if and to the extent required to comply with a legal regulation or court order, as well as on the basis of the following three legal grounds:

To implement a user agreement between you and Casa Rento or your request to conclude such an agreement

These grounds pertain when you, as a (potential) lessor, seller, lessee, or buyer of a holiday accommodation, make use of the Platform or register on the Platform. In the context of these legal grounds for the processing of personal data, Casa Rento processes your personal data exclusively if and to the extent this is required to take your request for registration under advisement or respectively to implement the user agreement concluded with you or respectively to implement the user agreement concluded with you, also including the ability to offer the functionalities of the Platform to you and to contact you to the extent this is necessary for the proper implementation of the user agreement.

In the context of the user agreement concluded with you, personal data may be shared with third parties. This is the case in the following situations:

1. If you, as a lessor or seller of a holiday accommodation, have concluded a user agreement with Casa Rento, you can make use of the functionalities of the Platform offered to you. In order to make it clear as a lessor or seller to (potential) lessees or buyers what lessor or seller the offer derives from, the offer is provided with a selection of (personal) data submitted by you as the lessor/seller. This is visible to all users of the Platform;
2. If you make use of the Platform as a (potential) lessee or buyer of a holiday accommodation, you are able to see the offer in holiday accommodations on the Platform. Personal data of you as a (potential) lessee or buyer are not published on the Platform;
3. Via a contact form attached to advertisements of lessors and sellers on the Platform, users of the Platform can communicate with each other. In order to call the attention of the relevant lessor or seller for a message you submitted, Casa Rento makes use of an SMS message function; 
4. If you, as a (potential) lessor or seller make a payment via the Platform, your personal data are shared with the relevant payment provider to the extent this is necessary in order to process your payment.

A legitimate interest of Casa Rento

These grounds pertain in case:

1. of the automatic provision by Casa Rento of the personal data submitted by you via the Platform and stored under your possible account of the Platform to the hosting party engaged by Casa Rento. This is required to have the Platform, the associated functionalities, and the e-mail facilities of Casa Rento function properly;
2. newsletter software is used to send you the newsletters requested;
3. of the use of review software to disclose such reviews as you may have posted on the Platform;
4. of the use of chat and/or WhatsApp software on the Platform to enable the relevant messaging function;
5. of the provision by Casa Rento of your personal data to an accounting firm to take care of the administration and accounts of Casa Rento;
6. your personal data are shared by Casa Rento with a provider of software for the processing and storage of the administration and accounts of Casa Rento;
7. of the use of cloud services for the storage of personal data, also including a CRM system for the optimisation of business processes, such as client management, order processes, and invoicing.

The providers of the computer programs/software referred to above save relevant personal data in order to be able to offer the functionalities of the software to Casa Rento.

In the context of these legal grounds, Casa Rento processes your personal data exclusively if and to the extent required to serve said legitimate interest.

Your consent

These grounds pertain when:

1. you contact Casa Rento in any manner, for example by e-mail or by way of the context form on the Platform. Your consent, after all, is implicit in the fact of your contacting us;
2. Casa Rento wants to use your personal data for other purposes still or wants to provide the same to third parties. It applies in this context that your consent always applies for a specific processing operation and a specific purpose. If Casa Rento has multiple purposes to process personal data, Casa Rento will inform you accordingly and request your permission for each purpose separately.

European Economic Area 

Casa Rento stores your personal data within the European Economic Area ("EEA"). It may occur, however, that certain personal data collected by Casa Rento are transmitted to or stored outside the EEA, because an external service provider of Casa Rento is established there. If this is the case, Casa Rento makes sure that the processing of your personal data outside the EEA takes place in a safe and lawful manner. In that context, Casa Rento will therefore take the necessary steps to guarantee that your personal data are adequately protected.

Access to personal data 

Exclusively collaborators of Casa Rento authorised to such effect have access to your personal data and solely to the extent this is necessary to carry out the tasks ordered to them. This also applies with respect to third parties as referred to above and with which Casa Rento shares personal data or to which you provide personal data directly. Casa Rento will under no circumstance sell your personal data. The persons falling under the responsibility of Casa Rento, as well as third parties engaged by Casa Rento, are obliged to respect the confidentiality of your personal data. To the extent Casa Rento outsources the processing of personal data to a third party, Casa Rento will take the steps required to guarantee you that your personal data are adequately protected. Such steps comprise, if and to the extent required by the law, the application of a processor agreement with such receivers so as to make sure that they take the same or comparable technical and organisational measures as Casa Rento, so that your personal data are adequately protected.

Cookies used by Casa Rento 

Casa Rento uses functional and analytics cookies (such as Google Analytics and Meta Pixel, which can collect data automatically when you visit the Platform). A cookie is a tiny text file which is stored on the browser of your device upon visiting the Platform. Casa Rento uses cookies with a solely technical functionality. These make sure that the Platform functions properly and, for example, that your preferential settings are remembered. These cookies are also used to let the Platform function properly and to be able to optimise it. 

In addition, Casa Rento collects information by way of analytics cookies for research so as to obtain better insight into the use of the Platform by its visitors and users. Analytics cookies help analyse in what manner the Platform is used by collecting login data and visitor behaviour on the Platform in anonymous form. 

It is further described in the cookie policy on the Platform to what extent Casa Rento makes use of cookies. 

Automated decision making

Casa Rento does not use your personal data for automated decision making. This goes without saying, of course, but Casa Rento is obliged to state as much.

Your rights

You have the right to ask Casa Rento to inspect, to have them delete, or to rectify your personal data, as well as to restrict the processing that regards you. You also have the right to object against the processing and you are entitled to data transferability. That means that you can submit a request to Casa Rento to send your personal data which are processed by Casa Rento in a computer file to you or to an organisation indicated by you.

In order to make sure that the request was made by you, Casa Rento asks you to attach a copy of your ID to your request. In this copy, redact the MRZ (machine readable zone, the bar with numbers on the document), the document number, and the social security number. This is to protect your privacy. Casa Rento will react to your request as soon as possible, though in any event within four weeks. 

To the extent the processing of personal data is based on the consent obtained from you, you have the right at all times to withdraw this consent, without this impairing the legitimacy of the processing based on the consent prior to the withdrawal thereof.

You have the right to file a complaint with privacy oversight agency Autoriteit Persoonsgegevens or in case you reside in a country other than the Netherlands with the oversight agency there.

Retention of personal data

Personal data are only retained by Casa Rento for as long as this is necessary considering the purposes they are processed for. Casa Rento implements appropriate technical and organisational measures to protect personal data against loss and against any form of unlawful processing. These measures guarantee, taking into account the state of the art and the costs of implementation, a level of security which, in view of the risks entailed by the processing and the nature of the personal data to be protected, is appropriate. The measures also aim to prevent the unnecessary processing of personal data.
